No reliance; your responsibility in the ocean
Surfing and ocean swimming carry inherent risks. Conditions change constantly, and information on this Site may be incomplete or out of date. You are solely responsible for assessing conditions and your own ability, checking current local information (such as the Beachsafe app and official surf lifesaving advice), surfing at patrolled beaches where possible, and following the directions of lifesavers and authorities. Do not rely on this Site as a substitute for real-time, official safety information.
Third-party links & operators
The Site describes and links to third-party businesses, including surf schools, camps and wave parks, and other external websites. We do not control and are not responsible for the content, products, services, availability, pricing or practices of those third parties. Any dealings you have with them are solely between you and that third party. References to third-party businesses are for information only.
Intellectual property
The design, text, graphics and other original content of this Site are owned by us or our licensors and are protected by applicable intellectual property laws. You may view and share the content for personal, non-commercial use. You may not copy, reproduce, republish or exploit the Site's content for commercial purposes without our prior written consent.
Acceptable use
- Do not use the Site for any unlawful purpose or in breach of these Terms.
- Do not attempt to gain unauthorised access to, interfere with, or disrupt the Site or its servers.
- Do not introduce malicious code or scrape the Site in a manner that burdens our infrastructure.
Disclaimer of Warranties
To the maximum extent permitted by law, the Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure or free of harmful components, or that information on the Site is accurate, complete or current. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded.
Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or in connection with your use of (or inability to use) the Site or your reliance on its content, even if we have been advised of the possibility of such damages. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant information or paying the cost of having it re-supplied.
Termination
We may suspend or terminate your access to the Site at any time, without notice, if you breach these Terms or if we discontinue the Site. You may stop using the Site at any time. Provisions that by their nature should survive — including Intellectual property, Disclaimer of Warranties, Limitation of Liability and the applicable-law provisions below — continue to apply after your use ends.
Changes
We may update these Terms from time to time. Changes take effect when posted on this page, and your continued use of the Site means you accept the updated Terms.
